Penalties for a Georgia DUI Conviction
- For a first conviction of a DUI in a 5-year period, here’s what to expect:
A total of a 12 month jail sentence. From 10 days to 12 months in jail. The mandatory minimum is 24 hours in jail and the remaining jail time can be suspended or probated by the Judge. For a first time offense, you can most likely expect to get the minimum of 24 hours in jail. Fines between $300 and $1,000, plus any surcharges. 40 hours of community service. DUI school or a Risk Reduction Course. A clinical evaluation for alcohol and drug dependency. Suspension of your license for 1 year. However, if you took the Risk Reduction Course, your license can be reinstated in 120 days.
- For a second conviction of a DUI in a 5-year period, here’s what to expect:
A total of a 12 month jail sentence. From 90 days to 12 months in jail. The mandatory minimum is 72 hours in jail and the remaining time can be suspended or probated by the Judge. Fines between $600 and $1,000, plus any surcharges. 30 days or 240 hours of community service. DUI school or a Risk Reduction Course. A clinical evaluation for alcohol and drug dependency. An ignition interlock installed in your vehicle and surrendering of all license plates on your vehicles. Your picture will be published in your local newspaper. Your license will be suspended for 18 months. With the ignition interlock, you can get your license back in 12 months.
- For a third conviction of a DUI in a 5-year period, here’s what to expect:
A total of a 12 month jail sentence. From 120 days to 12 months in jail. The mandatory minimum is 15 days in jail and the remaining time can be suspended or probated by the Judge. A fine of between $1,000 to $5,000, plus any surcharges. 30 days or 240 hours of community service. DUI school or a Risk Reduction Course. A clinical evaluation for alcohol and drug dependency. The installation of an ignition interlock system and surrending of your vehicles’ license plates. Your picture will be published in your local newspaper. Your license will be revoked for 5 years. After 2 years, you may obtain a probationary license.
